Interfax: Law on terrorist’s family liability for damage to enter into force on Nov 17

(Interfax – November 6, 2013) The law, which holds kith and kin of terrorists liable for the damage done by terrorist attacks, will enter into force on November 17. The president signed the law in early November.

The Federal Law “On Adjustment of Some Legislative Acts of the Russian Federation”, which amends the Russian Criminal Code, the Russian Civil Code and the Law “On Investigative Operations” in the section concerning compensations for the harm done by terrorist attacks, was published by Rossiyskaya Gazeta on Wednesday.

Pursuant to the Russian law, the document will enter into force ten days after its publishing, on November 17.

It was reported last Sunday that President Vladimir Putin had signed a law, which provided for the possibility of demanding compensation for the harm done by terrorists from their kith and kin.

The law was published on the official legal data portal.

“The moral and other damage done in a terrorist attack shall be compensated for in a procedure established by Russian civil laws at the expense of the person who committed the terrorist act and his kith and kin in the case of sufficient evidence that their money, valuables and other property were obtained as a result of terrorist activity and/or were returns on such property,” the law said.

The law’s explanatory note said that the court would impound money, valuables and other property unless the person in question could confirm their legality.
